Terms of Service

By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.

You must be at least 18 years old and capable of forming a binding contract to use our services. By creating an account on the Oasis platform, you represent that you meet these requirements.

When you create an account on the Oasis platform, you are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at support@oasispoolsandspanc.com

We reserve the right to suspend or terminate accounts that violate these Terms.

Pool service businesses ("tenants") who subscribe to the Oasis platform agree to the following additional terms:

• You are responsible for all customer data you upload, store, or manage within the platform
• You must obtain appropriate consent from your customers before entering their personal information into the platform
• You are responsible for your team members' use of the platform and ensuring they comply with these Terms
• Your subscription is billed according to your selected plan. We will notify you of any pricing changes at least 30 days in advance
• You may export your data at any time. Upon account termination, we will retain your data for 30 days before deletion unless you request immediate removal

For customers of our pool construction and maintenance services:

• Project estimates and quotes are valid for the period stated on the quote. Pricing may be adjusted for material cost changes or scope modifications
• Project timelines are estimates and may be affected by weather, permitting, material availability, or unforeseen site conditions
• Payment terms are as specified in your project agreement or invoice. Late payments may incur fees as stated on the invoice
• We carry appropriate insurance and licensing for pool construction in the state of North Carolina

By providing your phone number or email address, you consent to receive transactional communications related to your account, appointments, and services. This includes:

• SMS messages (appointment reminders, technician alerts, billing notices)
• Email notifications (service reports, invoices, account updates)

You can opt out of SMS at any time by replying STOP. See our SMS Policy for details. We do not send marketing or promotional SMS.

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees. All fees are in US dollars unless otherwise stated.

For platform subscriptions, billing occurs on a recurring basis according to your plan. You may cancel at any time; your access continues until the end of the current billing period.

All content, design, code, and branding associated with Oasis Outdoor Living and the Oasis platform are owned by Oasis Outdoor Living LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of all data you upload to the platform. By using our services, you grant us a limited license to process your data solely for the purpose of providing the services.

You agree not to:

• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the platform's infrastructure
• Upload malicious code, spam, or harmful content
• Resell, sublicense, or redistribute the platform without authorization
• Scrape, crawl, or use automated tools to extract data from the platform

To the maximum extent permitted by law, Oasis Outdoor Living LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or secure at all times.

You agree to indemnify and hold harmless Oasis Outdoor Living LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wake County, North Carolina.

We may update these Terms from time to time. When we make material changes, we will update the effective date and notify you via email or a notice on our website. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

Either party may terminate these Terms at any time. You may close your account by contacting us. We may suspend or terminate your access if you violate these Terms.

Upon termination, your right to use the platform ceases. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.
